Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all earnings made (INFO # 3) at the rate consented to by the employer and worker.

– Pay of a minimum of minimum wage (INFO # 1), the applicable Colorado or local minimum wage, and all earned overtime incomes without impermissible deductions from their salaries;.

– Pay of all made earnings without impermissible deductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS implements much of Colorado’s wage and hour and employment other types of labor statutes and labor rules, consisting of the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please check out the Division’s Labor Statutes and Labor Rules web pages for existing and previous versions of crucial Colorado labor statutes and guidelines.

Published Guidance: The Division’s main kinds of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally authorized notifications, opinions, and explanations on different labor law subjects; and.

– KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for workers on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you incomes, you can send your employer a written demand for payment of wages by mail, e-mail, text message, or other electronic methods. A written need may be sent out to the employer at the same time a Labor Standards Complaint Form for unpaid wages is submitted with the Division. The Labor Standards Complaint Form can be discovered on our Demands, Complaints, Responses, and Settlements website.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and examined, a letter discussing the nature of the complaint and employment the quantities alleged to be owed is sent to the company. Investigations Launched by the Division (” Direct Investigations”): The Division may carry out employer-wide direct examinations of possible infractions of Colorado wage and hour law. If you would like to submit an idea, please email the Division at [email protected]. If you wish to file an individual claim for unsettled earnings, you must fill out a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page.
